RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS AGREEMENT

THIS RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS AGREEMENT (hereinafter referred to as the “Release Agreement”).

By signing this document you will waive certain legal rights, including the right to sue or claims compensation following an accident while visiting Silverbrook Farm Inc.

PLEASE READ CAREFULLY!

To: SILVERBROOK FARM INC., its directors, officers, employees, elected officials, agents and volunteers (hereinafter called the “Releasees”).

This Release Agreement shall operate to protect the Releasees and is deemed to include all activities, events and services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall cover all areas in which Silverbrook Farm Inc. operates on the property located at: 1364 Bradner Road, Abbotsford, British Columbia, including, all bodies of water, natural and man-made terrain, either within or beyond the designated boundaries, including on pathways and trails, driveways, roads, and both indoor and outdoor areas (the “Property”).

This Release also operates to protect the Releasees from claims related to equipment used by guests of Silverbrook Farm Inc. or other facilities provided by the Releasees from time to time regardless of the activities and the use of the Property or part therof by authorized guests.

If the undersigned is renting the Property for a private event such that the undersigned will be inviting guests to attend the event on the Property, the undersigned assumes all liability for its guests (hereinafter “Invitees”), and by signing this release, all such Invitees are bound by the terms of this Release. Guests who rent the Property for private events, are required to carry an insurance policy for it’s specific event, suitable in the sole discretion of Silverbrook Farm Inc. and will provide a copy of any such insurance policy upon request.

ASSUMPTION OF RISKS

I am aware that participating in activities on a working farm involves many inherent risks, dangers and hazards including but not limited to: exposed and falling rock, earth, ice, trees or other natural objects; wildlife, farm animals and pets; plants; travel on back-country roads and trails; negligence of other guests and other persons; travelling on rough and uneven terrain; changing weather conditions which may cause the floor, ground and/or any equipment to be slippery; equipment failure; failure to properly adjust or fasten equipment; improper use of equipment; falls; over-exertion; failure to remain within designated areas; impact or collision with trees, vehicle traffic, and equipment; and negligence on the part of the Releasees, including the failure on the part of the Releasees to take reasonable steps to safeguard or protect me from the risks, dangers and hazards of a working farm. I freely accept and fully assume all such risks, dangers, and hazards and the possibility of personal injury, death, property damage or loss therefrom.

In consideration of the Releasees permitting me to enter the Property and allowing my participation in certain activities, specifically permitted on the Property I hereby agree as follows:

1. To waive any and all claims that I have or may in the future have against the Releasees and to release the Releasees from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, or any of my invitees may suffer, as a result of my or my Invitees presence on the Property, due to any cause whatsoever, including negligence, or breach of any statutory or other duty of care by the Releasees, and further including the failure on the part of the Releasees to take reasonable steps to safeguard or protect me or my Invitees from the risks, dangers, and hazards on the Property;

2. To hold harmless and Indemnify the Releasees from any and all liability for any property damage, loss or personal injury to any third party resulting from my or my Invitees presence on the Property;

3. This Release Agreement shall be effective and binding upon heirs, next of kin, executors, administrators, assigns and representatives, in the event of of death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction; and

5. Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of British Columbia and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia. In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of the Property, other than what is set forth in this Release Agreement.

Furthermore, I agree that by clicking here, that all minors and guests which accompany me to the Property are my legal responsibility, and I commit to being responsible for the safety and well being of myself and all guests accompanying me including any minors whether or not such minors are related individuals or family members of myself.
